Introduction and Scope Akitech Pty Ltd (ABN: 57 138 713 710) (trading as ResumeIQ) ("ResumeIQ," "we," "us," or "our") is committed to protecting your privacy and handling your personal information responsibly. This Privacy Policy describes how we collect, use, disclose, store, and protect your personal information when you use the ResumeIQ platform and related services (the "Service"). This Privacy Policy is prepared in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained therein. Where applicable, we also comply with the EU General Data Protection Regulation (GDPR) for users located in the European Economic Area, and the California Consumer Privacy Act (CCPA) for California residents. By using the Service, you consent to the collection and use of your personal information as described in this Privacy Policy. If you do not agree with this Policy, please do not use the Service. 2. Information We Collect 2.1 Personal Identification Information (PII) When you register and use the Service, we may collect: • Full name, email address, and password (hashed); • Professional details contained in your resume, including work history, education, skills, and qualifications; • Contact details you choose to include in resume content (e.g., phone number, LinkedIn profile, location); • Account preferences and settings. 2.2 Payment Information When you purchase a subscription, payment is processed by our third-party payment processor (currently Stripe, Inc.). ResumeIQ does not directly collect, store, or process full payment card details. We may receive and store: • Billing name and address; • Transaction identifiers and subscription status; • Last four digits of your payment card (for display purposes only). Stripe's handling of your payment data is governed by Stripe's own Privacy Policy, available at stripe.com/privacy. 2.3 Usage Data and Technical Information We automatically collect certain information when you use the Service, including: • IP address and approximate geolocation; • Browser type, version, and operating system; • Pages visited, features used, and time spent on the Service; • Referring URLs and clickstream data; • Device identifiers and session tokens. 2.4 AI Processing Data To deliver the core Service functionality, we process resume content and job descriptions you submit through our AI analysis pipeline. This includes text, formatting data, and metadata extracted from uploaded documents. 2.5 Communications If you contact us for support or other purposes, we may collect records of that correspondence, including email content. 3. How We Use Your Information We use your personal information for the following purposes: • To provide, operate, and maintain the Service, including AI-powered resume analysis and tailored resume generation; • To process payments and manage your subscription; • To create and manage your user account; • To communicate with you regarding your account, subscription, and service updates; • To send transactional emails and, with your consent, marketing communications; • To analyse usage patterns and improve the quality and performance of the Service; • To develop and train our AI models, using de-identified or aggregated data where practicable; • To detect, investigate, and prevent fraudulent activity, security incidents, and violations of our Terms; • To comply with legal obligations, including obligations under the Privacy Act 1988 (Cth) and the Notifiable Data Breaches scheme; • To enforce our Terms and Conditions and protect ${COMPANY}'s legal rights. 4. How We Share Your Information ResumeIQ does not sell your personal information. We may share your information with: 4.1 Service Providers and Processors We engage trusted third-party service providers who assist us in operating the Service, subject to contractual obligations to protect your data: • Payment processors (Stripe, Inc.) — for subscription billing; • Cloud infrastructure providers (e.g., Microsoft Azure, AWS, Supabase/PostgreSQL) — for hosting and data storage; • AI/ML API providers (e.g., Anthropic, Azure OpenAI) — for AI analysis and generation features; • Analytics and monitoring providers — for platform performance and error tracking; • Email delivery providers — for transactional and marketing communications. 4.2 Legal Requirements We may disclose your personal information if required to do so by law, court order, or governmental authority, or if we believe disclosure is necessary to: • Comply with a legal obligation under Australian or applicable international law; • Protect and defend the rights or property of ${COMPANY}; • Prevent or investigate possible wrongdoing in connection with the Service; • Protect the personal safety of users of the Service or the public. 4.3 Business Transfers In the event of a merger, acquisition, restructure, or sale of all or part of ResumeIQ's business or assets, your personal information may be transferred to the relevant successor entity, subject to equivalent privacy protections. 4.4 Aggregated and De-identified Data We may share aggregated or de-identified data that cannot reasonably be used to identify you for research, analytics, product improvement, or marketing purposes. 5. Data Security Measures ResumeIQ implements a range of commercially reasonable technical and organisational security measures to protect your personal information, including: • Encryption of data in transit using TLS/HTTPS protocols; • Encryption of sensitive data at rest; • Role-based access controls and least-privilege principles; • Multi-factor authentication for administrative access; • Regular security assessments and vulnerability monitoring; • Secure software development practices; • Third-party processor vetting and contractual data protection obligations. 6. Security Limitations Disclosure WHILE RESUMEIQ TAKES DATA SECURITY SERIOUSLY AND APPLIES THE MEASURES DESCRIBED ABOVE, NO METHOD OF TRANSMISSION OVER THE INTERNET AND NO METHOD OF ELECTRONIC STORAGE IS 100% SECURE. THE CYBERSECURITY THREAT LANDSCAPE IS CONTINUOUSLY EVOLVING, AND SOPHISTICATED HACKING TOOLS, ZERO-DAY VULNERABILITIES, RANSOMWARE, SOCIAL ENGINEERING ATTACKS, AND OTHER ADVANCED TECHNIQUES CAN POTENTIALLY COMPROMISE EVEN WELL-SECURED SYSTEMS. BY USING THE SERVICE AND SUBMITTING YOUR PERSONAL INFORMATION, YOU ACKNOWLEDGE AND ACCEPT THESE INHERENT RISKS. RESUMEIQ CANNOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR INFORMATION. In the event of a data breach that is likely to result in serious harm, we will comply with our obligations under the Notifiable Data Breaches (NDB) scheme (Part IIIC of the Privacy Act 1988 (Cth)), including notifying the OAIC and affected individuals promptly. 7. Data Retention We retain your personal information for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Specifically: • Account and profile data: retained for the duration of your account, plus up to 7 years after closure (for legal and tax compliance); • Resume content and analysis data: retained during your subscription; you may request deletion at any time; • Payment records: retained as required by Australian taxation and financial record-keeping laws (generally 7 years); • Usage and technical logs: retained for up to 12 months for security and operational purposes; • Marketing communications: until you unsubscribe or withdraw consent. Upon account deletion, we will take reasonable steps to delete or de-identify your personal information, subject to any legal retention obligations. 8. Your Rights Under the Australian Privacy Principles and, where applicable, the GDPR and CCPA, you have the following rights regarding your personal information: • Access: Request a copy of the personal information we hold about you; • Correction: Request correction of inaccurate, incomplete, or outdated information; • Deletion: Request deletion of your personal information, subject to our legal retention obligations; • Portability (GDPR): Request a machine-readable copy of your data; • Restriction: Request that we restrict processing of your data in certain circumstances; • Objection: Object to processing based on legitimate interests; • Withdraw Consent: Withdraw consent for marketing communications at any time; • Complaint: Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au if you believe we have mishandled your personal information. We may require identity verification before processing requests. 9. Cookies and Tracking Technologies The Service uses cookies and similar tracking technologies (e.g., pixels, local storage, session tokens) to: • Maintain your login session and authentication state; • Remember your preferences and settings; • Analyse usage patterns and improve Service performance; • Enable security features. You can control cookie settings through your browser preferences. Disabling certain cookies may affect the functionality of the Service. We do not currently use cookies for cross-site tracking or targeted advertising. 10. Third-Party Links and Services The Service may contain links to third-party websites or integrate with third-party services (e.g., job boards, LinkedIn). ResumeIQ is not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party services you access through the Service. 11. Children's Privacy The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected personal information from a child under 18, we will take steps to delete that information promptly. However, some of our third-party service providers (including cloud infrastructure and AI/ML API providers) may process or store data in jurisdictions outside Australia, including the United States and the European Economic Area. Where personal information is transferred overseas, we take steps to ensure those recipients are subject to comparable data protection obligations, including contractual arrangements, certifications, or adherence to recognised frameworks (such as the EU Standard Contractual Clauses or equivalent). By using the Service, you consent to these cross-border transfers as described in this Policy. 13. Changes to Privacy Policy ResumeIQ may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. We will notify you of material changes by: • Posting the updated Privacy Policy on our website with a revised effective date; • Sending a notification to the email address associated with your account; and/or • Displaying an in-app notification. Your continued use of the Service after the effective date of any updated Privacy Policy constitutes your acceptance of the revised terms. We encourage you to review this Policy periodically. 14.
